Real Estate Practice Group

Greene & Markley’s real estate lawyers serve clients in all types of commercial and residential real estate transactions and handle many other matters involving real property.

Transactions and Documentation

As part of our real estate practice, we represent buyers, sellers, lenders, developers, lessors and lessees. We advise and assist our clients with respect to all forms of real estate transactions, including preparation and review of declarations of covenants, conditions and restrictions, earnest money agreements, leases, deeds, easements, land sale contracts and other agreements, security instruments and related loan documents. We assist our clients in “like-kind” exchanges under Internal Revenue Code Section 1031 and in resolving various title issues. We work closely with title companies to assure that even the most complex transaction closes smoothly. We proceed efficiently to ensure quality work at a reasonable cost.

Litigation

Greene & Markley’s real estate lawyers understand that real estate transactions, however well-conceived, documented and executed, may result in disputes. We represent clients in litigation of title disputes, boundary disputes, easement disputes, commercial or residential lease disputes, eviction proceedings and foreclosures of all types of real property security interests.

Collection/Bankruptcy

Our experience in debtor/creditor matters enables our attorneys to handle all kinds of collection matters involving real property, including foreclosures of all forms of liens and judgment executions against real property. We assist creditors in the bankruptcy court to protect their rights and liens or claims to real property, including relief from the automatic stay, proofs of claims and plan confirmations. Greene & Markley has extensive experience representing trustees, debtors and creditors in bankruptcy proceedings involving real property and with real property liquidations in bankruptcy.
